TERMS AND CONDITIONS OF SALE (T&Cs – Consumer Customers)

Article 1 – Scope

These Terms and Conditions of Sale (hereinafter the “T&Cs”) apply, without restriction or reservation, to all sales of cosmetic products concluded between:

  • Rose Lane Cosmétiques (RL) (hereinafter “Rose Lane” or the “Seller”), operating the website www.roselane.fr (hereinafter the “Website”),
  • and any natural person of legal age acting as a consumer, for their personal and non-professional needs (hereinafter the “Customer”).

The T&Cs set out in particular the conditions for orders, payment, delivery, right of withdrawal, returns, warranties and liability.

These T&Cs are to be read together with the following policies available on the Website:

By placing an order on the Website, the Customer is deemed to have read and accepted these T&Cs and the policies listed above, which form an integral part of the contractual relationship.

Any order placed on the Website implies full and unreserved acceptance of these T&Cs. The T&Cs are accessible at any time on the Website and shall prevail, where applicable, over any other version or conflicting document.

Article 3 – Products

3.1 Product features

The products offered for sale on the Website are makeup and skincare products made in France from carefully selected ingredients.

For each product, the Customer has access to a detailed description on the Website specifying its essential characteristics (shade, texture, composition, formula, directions for use, volume, etc.), in accordance with Article L.111-1 of the French Consumer Code.

The photographs, videos and lifestyle images on the Website are for illustrative purposes only. Minor differences in colour or appearance may occur due to, in particular:

  • screen settings and brightness,
  • the natural lip colour, skin tone or lighting used during shooting.

Such differences do not constitute a lack of conformity.

3.2 Use of the products

The products sold by Rose Lane are intended for strictly personal and non-professional use.

The information provided on the Website (usage tips, beauty advice, routine recommendations, etc.) is intended solely to guide the Customer in the use of the products. It does not constitute medical advice or a diagnosis.

Products must be used:

  • in accordance with their intended purpose,
  • in line with the precautions for use indicated on the packaging, any leaflet and/or on the Website,
  • taking into account any contraindications (very sensitive skin, known allergies to certain ingredients, etc.).

Some products may contain concentrated actives (plant oils, waxes, butters, natural extracts, etc.) which may not be suitable for all skin types. It is the Customer’s responsibility to check the ingredient list (INCI) before use and, in case of doubt, to perform a patch test on a small area of skin or consult a healthcare professional.

Rose Lane shall not be held liable:

  • in case of misuse of the products,
  • in case of failure to comply with the precautions for use,
  • in case of reaction related to a known allergy or a particular sensitivity not previously discussed with a healthcare professional.

The manufacturing and placing on the market of Rose Lane cosmetic products are governed by Regulation (EC) No. 1223/2009 and the French Public Health Code. Any Customer wishing to use the products in a professional setting or to develop preparations for commercial purposes must comply with these regulations and shall do so under their sole responsibility.

3.3 Compliance

The products sold by Rose Lane comply with the French and European regulations in force at the time they are placed on the market, particularly in relation to cosmetic product safety, consumer health protection and fair commercial practices.

3.4 Availability of stock

Products are offered for sale and delivered while stocks last.

If a product becomes unavailable after an order has been confirmed, Rose Lane shall inform the Customer by e-mail as soon as possible and offer the Customer the following options:

  • a product of equivalent quality and price, or
  • a credit note for the amount of the unavailable product, or
  • a full refund of the amounts paid for the unavailable product.

The refund shall be made within a reasonable period and, in any event, in compliance with applicable legal obligations.

Beyond the refund of the unavailable product, no additional compensation may be claimed by the Customer, except in cases of proven fault by the Seller.

3.5 Resale of products

Products sold on the Website are intended exclusively for the Customer’s personal use.

Any resale, repackaging or commercial distribution of Rose Lane products, without prior written authorisation from the company, is strictly prohibited and may give rise to civil and/or criminal proceedings.

Article 4 – Prices

Product prices are indicated on the Website in euros (€), all taxes included (VAT), taking into account the VAT applicable on the date of the order.

The Seller reserves the right to modify prices at any time. Products are invoiced on the basis of the prices in force at the time the order is confirmed by the Customer.

The applicable shipping fees are indicated before the final validation of the order and are shown separately on the order summary. From time to time, promotional offers or discount codes may be made available. Unless otherwise stated, such advantages cannot be combined and are only valid for the period and under the conditions specified on the Website.

Article 5 – Orders

To place an order, the Customer must:

  • select the products and add them to the cart,
  • check the details of the cart and correct any errors,
  • enter their contact and delivery details,
  • choose a shipping method,
  • choose a payment method,
  • confirm the order after reading and accepting these T&Cs.

Final validation of the order constitutes an electronic signature which has the same value as a handwritten signature between the parties and is binding upon the Customer.

Rose Lane reserves the right to refuse any order that appears abnormal (unusually high quantities, suspected resale, bad faith, previous dispute, etc.) or in case of a payment issue.

The order is considered final only after confirmation by e-mail and full receipt of payment by the Seller.

Article 6 – Payment

Payment for the order is made at the time of confirmation, using the payment methods offered on the Website, including:

  • bank cards (Visa, Mastercard, etc.),
  • Cartes Bancaires / CB,
  • American Express,
  • Apple Pay,
  • PayPal,
  • instalment payment via Klarna (3 interest-free instalments, subject to eligibility and Klarna’s own terms and conditions).

The exact list of available payment methods is shown during checkout and may change over time.

Payments are processed via secure payment service providers. The Customer’s bank details are encrypted during transmission and are not stored by Rose Lane.

If the Customer’s bank refuses payment, the order is automatically cancelled. Once payment is validated, the sums paid are definitively acquired by the Seller, without prejudice to the Customer’s right of withdrawal as provided for in Article 8.

Article 7 – Delivery

7.1 Delivery address

Products are delivered to the address provided by the Customer when placing the order. The Customer is responsible for the accuracy of the information provided (name, address, building number, access codes, intercom, etc.).

If a delivery failure or delay results from inaccurate or incomplete information provided by the Customer, any additional shipping costs for re-delivery shall be borne by the Customer.

7.2 Delivery times and methods

The delivery methods (delivery areas, carriers, approximate delivery times, available options, etc.) are set out in detail in the Shipping Policy, available at: https://www.roselane.fr/en/policies/shipping-policy

The indicated delivery times are estimates. Any reasonable delay in delivery shall not, in itself, give rise to compensation.

In accordance with the French Consumer Code, if no delivery has taken place within thirty (30) days of the order date, the Customer may request that the Seller deliver the products within an additional reasonable period and, if delivery has not occurred within that additional period, request cancellation of the sale and a full refund of the amounts paid.

7.3 Transfer of risk

The risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the products.

The Customer is strongly advised to check the condition of the parcel and the products upon delivery and to make any necessary reservations to the carrier (open parcel, damaged parcel, missing products, etc.), then to inform Rose Lane as soon as possible.

Article 8 – Right of withdrawal

8.1 Principle

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the order to exercise their right of withdrawal, without having to give any reason and without incurring any costs other than the cost of returning the products and, where applicable, any reduction in value of the products resulting from handling other than that necessary to establish their nature, characteristics and proper functioning.

To exercise the right of withdrawal, the Customer must contact Rose Lane by e-mail at contact@roselane.fr, indicating the order number, the products concerned and their clear decision to withdraw.

8.2 Conditions for returns under the right of withdrawal

Products must be returned:

  • in their original condition,
  • unopened, unused and untested,
  • in their original packaging (box, sleeve, seal, protective materials, etc.),
  • and, where applicable, with any free items supplied with the order.

In accordance with legal provisions, the right of withdrawal cannot be exercised for products which have been unsealed after delivery and cannot be returned for hygiene or health protection reasons (opened, tested or visibly used makeup and skincare products).

If the return conditions are not met (product opened, used, damaged, incomplete, etc.), Rose Lane may refuse the refund, in accordance with the Refund Policy.

8.3 Refund

Where the right of withdrawal is validly exercised, Rose Lane shall refund the amounts paid by the Customer, including the initial shipping fees at the standard rate, within a maximum of fourteen (14) days from the date on which Rose Lane was informed of the Customer’s decision to withdraw.

Rose Lane may however delay the refund until products have been received or until the Customer has provided proof of shipment of the products, whichever occurs first.

Refunds will be processed using the same payment method as that used for the original transaction, unless the Customer expressly agrees to a different method.

The costs of returning the products are payable by the Customer and may, where applicable, be deducted from the refund amount when the Seller provides a prepaid return label, as described in the Refund Policy.

Article 9 – Returns, refunds and exchanges outside the right of withdrawal

Outside the legal right of withdrawal, the conditions applicable to returns, refunds and exchanges (for example, in the event of damaged products or issues with transport) are described in greater detail in the Refund Policy, available at: https://www.roselane.fr/en/policies/refund-policy

In particular, the Customer may request a return or refund where the product shows a lack of conformity or a defect making it unfit for its usual intended use.

In such cases, the Customer is invited to contact the customer service team at contact@roselane.fr, specifying the order number, the product concerned, a description of the defect observed and, if possible, photographs supporting the claim. Rose Lane will review the request and, if a defect is confirmed, may offer a replacement product (subject to availability) or a refund, and may bear the return shipping costs in that context, in accordance with applicable legal provisions.

Article 10 – Statutory warranties

Products sold on the Website benefit by operation of law from the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Under the legal warranty of conformity, the Customer has two (2) years from delivery of the product to act; the Customer may choose between repair or replacement of the product, subject to the cost conditions set out by law; the Customer is not required to prove the existence of the lack of conformity of the product during the twenty-four (24) months following delivery.

Under the warranty against hidden defects, the Customer may choose either to cancel the sale or to keep the product and obtain a price reduction, in accordance with Article 1644 of the French Civil Code.

These warranties do not cover damage arising in particular from abnormal or non-compliant use, lack of maintenance, modification or alteration of the product, or professional use of products intended for private domestic use.

Article 11 – Liability

Rose Lane is only bound by a best-efforts obligation (obligation de moyens) for all stages of access to the Website, order processing, delivery and after-sales services.

Rose Lane shall not be liable for any indirect, immaterial or unforeseeable damage on the date of the order, nor in case of use of the products that is non-compliant with their intended purpose or the instructions provided, nor for damage caused by the Customer, a third party or a case of force majeure.

Hyperlinks on the Website may redirect to third-party websites or external resources. Rose Lane shall not be liable for the content, operation or any damage arising from the use of such third-party sites.

In any event, any potential liability of Rose Lane, whatever the cause, shall be limited to the total amount of the order concerned.

Article 12 – Intellectual property

All elements of the Website (texts, visuals, photographs, videos, logos, trademarks, graphics, icons, sounds, designs, layouts, etc.) are protected by intellectual property rights and are the exclusive property of Rose Lane or its partners.

Any reproduction, representation, adaptation, modification, translation, exploitation or distribution, in whole or in part, of the Website or any of its elements, on any medium whatsoever and by any means, without the prior written consent of Rose Lane, is strictly prohibited.

Article 13 – Personal data

Personal data collected during browsing on the Website and when placing an order (first name, last name, address, e-mail, telephone, payment data, order history, etc.) are processed by Rose Lane for the management of orders, payments, deliveries and returns, communication with the Customer (customer service, order information, etc.) and, where applicable, the sending of commercial offers and newsletters (with the Customer’s consent where required by law).

The Customer has the right to access, rectify, object to, restrict, erase and port their personal data, which may be exercised by contacting Rose Lane at: contact@roselane.fr.

In the event of any discrepancy between these T&Cs and the Privacy Policy regarding the processing of personal data, the Privacy Policy shall prevail.

Article 14 – Archiving – Evidence

Rose Lane archives order forms and invoices on a reliable and durable medium constituting a true copy. The computer records of Rose Lane, kept under reasonable security conditions, shall be considered as evidence of communications, orders, payments and transactions between Rose Lane and the Customer.

Article 15 – Force majeure

Rose Lane shall not be liable for the non-performance or delay in the performance of any of its obligations under these T&Cs where such non-performance or delay is due to a force majeure event, as defined by French law and case law.

Force majeure events include, without limitation: natural disasters, fires, floods, epidemics, strikes, wars, acts of terrorism, failures of communication networks, transport disruptions, decisions of public authorities, or any other circumstance reasonably beyond the control of Rose Lane.

Article 16 – Amendments to the T&Cs

Rose Lane reserves the right to amend these T&Cs at any time, in particular to reflect legal, regulatory or technical developments.

The applicable T&Cs are those in force at the time the order is confirmed by the Customer. The current version is available at any time on the Website.

Article 17 – Governing law – Disputes – Mediation

These T&Cs and any resulting transactions are governed by French law.

In the event of any difficulty, the Customer is invited to contact Rose Lane’s customer service team first, in order to seek an amicable solution.

If no amicable agreement is reached, the consumer Customer may refer the matter, free of charge, to a consumer mediation scheme. The contact details and terms for referral to the competent mediator may be provided to the Customer upon request or made available on the Website.

If mediation is not used, or if it fails, any dispute relating to the interpretation, validity or performance of these T&Cs shall be submitted to the competent French courts, in accordance with applicable rules of jurisdiction.
